API Yandex. Webmaster. Terms of Service

This document is a translation of User Agreement for Yandex Services in English. In case of conflict between the Russian version of User Agreement for Yandex Services and this translation - only the Russian version of User Agreement for Yandex Services is legally binding. This document (hereinafter referred to as the “Terms and Conditions”) constitutes an offer of YANDEX LLC (hereinafter referred to as "Yandex") to an Internet user (hereinafter referred to as the "User"), to use API Yandex Webmaster Service on the terms and conditions set forth below:

1. General Terms and Conditions

1.1 Terms and Definitions

Client Application means a unique identifier (UID), issued to the User, that allows to have an access to the functions of the Service.

Data means data provided by the Service to End users, that is to show the index made by Yandex search engine for the sites, provided by Yandex. Webmaster.

Extended Data means data provided by the Service to End Users, including Data and information about the external references to the sites of the End Users.

Service means API Yandex Webmaster Service, that is a software interface providing an online access to particular functions of Yandex. Webmaster

User's site means the User's online resources.

User's application means the User's applications developed using the Service.

End Users mean visitors of online resources, including those who use the User's site and its services for hosting external resources on the Internet.

Yandex Webmaster - means a Yandex online service showing the index made by Yandex search engine for the Users' sites. The service is located at: http://webmaster.yandex.ru.

1.2 Service, provided to the User, is subject to these Terms and Conditions and is also regulated by:

1.3 Upon using the Service or its particular functions, which includes registration of the User’ s Application, registration on the Service, placing the service code on a User's site or Application, or using any other Service function, the User shall be considered to have accepted these Terms and Conditions as well as the terms and conditions specified in the documents set forth in Clause 1.2. herein, and shall fully comply with them in full without any restrictions and exclusions. The Use of the Service on terms and conditions other than those specified herein, is not allowed without Yandex's prior consent. If the User disagrees with any of the Terms and Conditions herein or terms and conditions specified in the above-mentioned documents, he or she is not entitled to use the Service.

1.4 The User shall assume the sole responsibility for their compliance with applicable law while using the Service. Unless expressly stated otherwise, the term "law", mentioned herein, means any applicable law including laws of Russia as well as laws of where the User currently resides or performs an act related to these Terms and Conditions. If the use of a particular Service function violates the law, the User agrees to refrain from the use of the Service. The User shall undertake personally and at their own cost to settle all claims and/or lawsuits of third parties, prompted by the User's actions related to the use of the Service, and fully reimburse any losses, if any, incurred by Yandex.

1.5 These Terms and Conditions, as well as the relationship between Yandex and the User, arising from the use of the Service, shall be governed by the law of the Russian Federation.

2. Terms of Use

2.1 Under these Terms and Conditions, the User may act either as the owner of the Site specializing, generally or particularly, in web hosting services to an unlimited number of third-parties, including placement of third-parties' information resources on the User's servers with an online access; or the User may act as a software developer for such information resources.

2.2. Through the use of the Service, the User receives Data (Extended Data) about End Users' sites and displays it on the User's site or in a User's Application as it is specified by these Terms and Conditions. Yandex ensures the transmission of Data (Extended Data) received via Yandex Webmaster technology, to the User in accordance with the terms and restrictions specified in these Terms and Conditions. The User sends requests to the Service in accordance with the technical specifications set forth in API Yandex Webmaster Developer's Guide currently located at: http://api.yandex.ru/webmaster.

2.3 The User provides End Users with an access to Data (Extended Data) about End Users' websites, that the User receives from Yandex via Service. The end user who wants to use this function, agrees for downloading Data (Extended Data) by the User via OAuth protocol. The User shall not download Data (Extended Data) without the end user's consent.

2.4 Yandex, at its own discretion, may define and modify the content and the volume of Data (Extended Data) as well as the principles and terms of the User's use of Data (Extended Data) or any part of it. Yandex provides the User with the right to use Data (Extended Data) and / or any part of it in electronic format by displaying it on the Site or in a User's Application and addressing it exclusively to the End User owning the online resources which those Data (Extended Data) refers to. This right is not subject to any territorial restrictions as long as the User fully complies with these Terms and Conditions.

2.5. In order to access the Service, the User shall register Client's Application, filling in the form located at https://oauth.yandex.ru/client/new. Yandex at its own discretion may refuse access to the Service without stating a reason. The User may not use any software, devices or other tools that allow to register Client's Applications automatically or otherwise in violation of the procedure laid down by Yandex.

2.6. The User may use the Service only for computer applications and online services open to free and unlimited public access. The User may not use the Service for the projects with limited access by third parties. Requirement to register is not considered to be a limitation of access under this clause.

2.7. While using the Service, the User shall refer to Yandex technology by placing Yandex logo and text "The Data is provided by Yandex Webmaster Service" on the User's Site or in the User's Application in the immediate vicinity of the output Data received from the Service, along with a hyperlink to http://webmaster.yandex.ru on the words "Yandex Webmaster". Also the User shall indicate that the Data is stored on Yandex resources. While using the Service, the User may not remove, obscure or modify any trademarks, logos, links or other references to Yandex or other parties, contained in the Service or received with it, as well as as any other notices and/or information provided by the Service.

2.8. The User may not store, process, manage, modify Data and Extended Data, transfer it to third parties and use it in other ways than specified herein.

2.9. The User may not use the Service to create online-services, software or otherwise, if such use violates Law, the documents specified in clause 1.2 herein, and/or the rights and legitimate interests of third parties.

2.10. Yandex reserves the right to modify, fix or update Service at any time without prior notice to the User. After the release of a new stable version Yandex announces this release on Service Web pages. After the release of the newer version of the Service, Yandex does not guarantee the stability and duration of its older versions. The User who declines to update the version of theService may continue to use at his or her own risk an outdated version or stop using the Service.

3. Intellectual property rights

3.1. The Service is an exclusive property of Yandex. Exclusive rights to the Data and Extended Data belong to Yandex or other copyright holders. These Terms and Conditions do not entitle the User to employ the Service or the Data beyond the features provided by the Service interface in accordance with the Terms and Conditions herein.

3.2. By using the Service the User allows Yandex to employ the logo, trademark and/or brand name of the User and/or the User's Site for information, advertising or marketing purposes without further User's consent and any remuneration for such use.

4. Disclaimer

4.1. The Service (including the Data and Extended Data) is provided by Yandex "as is". Yandex does not guarantee that the Service and the Data (Extended Data) meet the User's expectations and goals, nor does it guarantee uninterrupted and error-free operation of the whole Service or its parts, components and/or functions, as well as credibility, accuracy, completeness, and relevancy of the Data (Extended Data). Yandex does not guarantee uninterrupted and error-free operation of third-party software products and solutions (including libraries), recommended for use with the Service in the technical specifications and other documentation related to it. Yandex is not liable for damages, direct or indirect, caused to the User or to third parties and resulting from the use or inability to use the Service and does not cover any of it.

4.2. The User shall bear full responsibility for the use of the Client's Application. The User is not entitled to register a Client's Application for third parties and transfer or provide it to them. Yandex is not liable for any unauthorized use of the Client's Application by third parties. All actions performed within the Service using a User-owned Client's Application, are considered to have been performed by the User.

5. Final provisions

5.1. Yandex may, at its own discretion and without any notice, terminate or suspend the User's access to the Service or its particular functions, using his or her account and/or Client's Application, without stating a reason, including in case of violation of the Terms and Conditions by the User.

5.2. All questions and claims related to the use/inability to use the Service shall be sent via a feedback form at: https://feedback2.yandex.com/api-webmaster.

5.3. Yandex may change the Terms and Conditions at any time without notice. The current edition of the Terms and Conditions is available at: https://yandex.ru/legal/webmaster_api. The new edition of the Terms and Conditions enters into force after publishing at the Web address specified in this paragraph. Continued use of the Service after changes of Terms and Conditions shall constitute User's consent to its most recent edition. The User shall stop using the Service, if he or she does non agree to any changes made by Yandex in the Terms and Conditions.
