Micro-Markup Validator API Service User Agreement

This document is a translation of Micro-Markup Validator API Service User Agreement in English. YANDEX Limited Liability Company (hereinafter referred to as Yandex) offers an Internet user (hereinafter referred to as the User) to use the Micro-Markup Validator API Service on the terms outlined herein (hereinafter referred to as the Terms).

1. General Provisions

1.1. Terms and Definitions

Service means the Micro-Markup Validator API Service, which is a programming interface that allows checking the semantic markup integrated in a Web site to make sure that search engine robots are capable of extracting structured data.

API Key means a unique identifier provided to the User to get access to the Service functions from their Web site(s).

Data means information received from the Service to be displayed to Users, including without limitation the following information: structured data extracted from the Webpage Micro-Markup, reports of errors committed in the Webpage Micro-Markup.

Micro-Markup (Semantic Micro-Markup) means Webpage markup with additional tags and attributes in tags denoting the meaning of the Webpage content for search robots.

1.2. When using the Service, the User shall comply with these Terms as well as with:

By starting to use the Service or its individual functions, specifically, by getting an API Key, creating a user account in the Service, publishing the service code on their Web site or employing any other functional optionality offered by the Service, the User shall be deemed to have agreed to these Terms, as well as to the terms and conditions of all the documents referred to in Clause 1.2 above, to the full extent and without any reservations or exceptions, and undertakes to abide by the foregoing. Using the Service on terms other than the terms and conditions of the specified documents may be allowed exclusively upon prior written consent of Yandex. If the User does not agree to any of the terms and conditions of the specified documents, the User may not use the Service.

1.4. The User shall be solely responsible for complying with the Legislation when using the Service. Throughout the text hereof, unless expressly stated to the contrary, the term “Legislation” shall imply any applicable legislation, including the legislation of the Russian Federation as well as the legislation at the User’s place of residence or place where the User performs legally significant acts in accordance with these Terms. If, by using any option offered by the Service, the User breaches the Legislation, the User shall refrain from using the Service.

1.5. These Terms and relationships arising between Yandex and the User in connection with the use of the Service shall be subject to the laws of the Russian Federation.

2. Use of the Service

2.1. In order to obtain access to the Service, the User shall create a user account according to the established procedure and get an API Key. Yandex may deny the access to the Service at its discretion without giving any reason. The User may not use any programmes, devices or other facilities enabling the User to get an API Key automatically or otherwise in violation of the procedure established by Yandex.

2.2. The User may use the Service only as part of online services and computer programmes available for free use by the general public. The User may not use the Service for projects requiring payment or otherwise restricting third-party access thereto. For the purpose of this clause, the requirement to create a user account shall not be deemed an access restriction.

2.3. The User may use the data and functions obtained with the use of the Service solely within the scope of the functionality offered by the Service.

2.4. The User may not change, decompile and/or otherwise modify the source code obtained through the Service.

2.5. The User may save, process and modify the Data, except for the Data extracted from the Micro-Markup of pages, where the owner of such pages has expressly prohibited the extraction of data with the use of the Service.

2.6. The maximum number of requests for Receivers shall be 10 (ten) requests per second. This number may be changed without any prior notice to the Receiver. If the maximum number of Service requests is exceeded, Yandex may discontinue providing the Service to the Receiver.

2.7. The User may not use the Service for the purpose of creating online services, computer programmes or otherwise if such use leads to violation of the Legislation, breach of the documents referred to in Clause 1.2 above and/or infringement of third party rights and legitimate interests.

2.8. The User is hereby notified and agrees that the Service may receive data on Web sites of the User and the User’s partners and transmit them to Yandex.

2.9. Yandex reserves the right to change, revise or update the Service at any time, without any prior notice to the User. When releasing the next stable version, Yandex shall announce its release on the Web pages of the Service. After releasing an updated version of the Service, Yandex shall not guarantee the stability and running operation of the out-of-date versions. If the User does not agree to use an updated version of the Service, the User may continue using the out-of-date version of the Service at the User’s own risk and peril or discontinue the use of the Service by deleting the corresponding code from the User’s Web site(s).

2.10. Yandex may at its discretion discontinue or suspend the User’s access to the Service without any notice and without giving any reason, specifically, if the User breaches the requirements outlined herein.

3. Intellectual Rights

3.1. The exclusive right to the Service shall belong to Yandex. The exclusive rights to the Data shall belong to Yandex or other right holders. These Terms shall not grant the User any rights to use the Service or Data beyond the options directly offered in the Service interface in pursuance hereof.

3.2. By using the Service, the User shall authorize Yandex to use the logo, trademark and/or brand name of the User and/or the User’s Web site for informational, advertising and marketing purposes, without having to obtain any additional consent of the User and without paying the User any fee for such use.

4. Disclaimer

4.1. The Service (including the Data) shall be provided by Yandex ‘as is’. Yandex shall provide no guarantee as to the consistency of the Service and the Data with the User’s goals and expectations, uninterrupted or error-free operation of the Service as a whole and of its individual components and/or functions, and/or as to the reliability, accuracy, completeness and timeliness of the Data. Yandex shall not guarantee uninterrupted error-free operation of third-party software products or solutions (including libraries) recommended to be used in the Service in technical conditions and other documents relating to its use.

4.2. The User shall be solely and fully liable for the use and integrity of the User’s API Key. The User may not receive the API Key for third parties, transfer or make it available to third parties. Yandex shall bear no liability for the unauthorized use of the API key by third parties. All actions performed in the Service with the use of the User’s API Key shall be deemed as performed by the User.

4.3. The User shall be solely and fully liable for the use of personal data of third parties when using the Service. In case of any claims against Yandex in connection with the User’s use of personal data of third parties in violation of the requirements of the effective legislation with respect to personal data, the User undertakes to settle such claims by the User’s own efforts and at the User’s own expense. Should any violations committed through the fault of the User as stated herein be detected, Yandex reserves the right to apply the measures stipulated in Clause 2.10 above to the User.

5. Final Provisions

5.1. Yandex may at any time without any notice discontinue or suspend at its own discretion the User’s access to the Service or its individual functions through the User’s account and/or API key without giving any reason, specifically, if the User breaches the requirements set out herein.

5.2. All questions and complaints in connection with the use of/inability to use the Service shall be submitted via a feedback form to http://feedback2.yandex.ru/api-microtest.

5.3. Yandex may at any time without any notice to the User amend the text of these Terms. The current version of these Terms is available at https://yandex.ru/legal/microtest_api/. A revised version of the Terms shall take effect as of its publication on the Internet at the address specified in this clause. The continued use of the Service upon amendment of the Terms shall be deemed the acceptance of the revised version thereof. The User shall discontinue using the Service if the User does not agree to any of the amendments made by Yandex.
